Australia is an open market with one genuine structural problem: the clock. Access is not the issue — almost every firm accepts Australians and one major firm is Australian-backed — but the US session opens in the middle of the night in Sydney, and the London session opens in the evening. The ASIC leverage cap does not apply to you here — and why that cuts both ways

ASIC's product intervention order caps retail CFD leverage at 30:1 on major FX pairs and 20:1 on major indices for Australian-licensed brokers. Offshore prop firms are not Australian-licensed brokers, and you are not opening a CFD account with them, so those caps do not constrain the evaluation you buy.

That is why an Australian trader can access effective leverage on a prop account that no domestic broker will offer. It is also why you have none of the protections that came with the same order: no negative-balance guarantee that means anything, no standardised risk warnings, no AFCA complaints route, no client-money segregation.

Reading that trade-off honestly is the whole job. The upside of the prop model for an Australian is genuine — capital access far beyond what 30:1 on your own savings provides — and the counterparty risk is entirely uninsured. Concentrating your evaluation spend at firms with a long, evidenced payout record is not conservatism, it is the only risk control available to you.

Designing around the AEST clock

The US cash equity session runs 00:30-07:00 AEST during Australian summer and 01:30-08:00 in winter. The London open is 18:00-19:00 AEST. The Asian session — Tokyo and Sydney — runs through the Australian morning but has thinner ranges on the majors and almost no participation in US index futures.

This has three practical consequences. First, if your strategy needs the New York open, you are trading between midnight and 3am; a firm with a minimum-trading-days rule will require you to do that repeatedly, and fatigue-driven rule breaches are how those accounts die. Second, if you want to trade in your own daytime, gold and the AUD pairs in the Asian session, or crypto around the clock, are your realistic instruments. Third, swing-friendly firms with no daily loss limit pressure and no minimum-days requirement are structurally better suited to Australians than to Europeans.

Weekend and overnight rules matter more from Australia

Because you cannot be at the screen during the highest-volatility US hours, you will hold positions across sessions more often than a US-based trader would. That makes two rules disproportionately important: whether the firm permits holding over the weekend, and whether it permits holding overnight at all.

Firms with a Friday-close flat rule effectively force you to exit during the Australian Saturday morning or be auto-liquidated with a rule violation logged. Firms charging swap on overnight CFD positions add a real cost to a strategy you are running only because of your timezone. AUD payout mechanics

Firms settle in USD or stablecoin. An Australian bank converting an inbound USD wire typically applies a 2.5-3.5% spread plus a receiving fee, so the naive route costs a working trader thousands a year.

Wise, Revolut or an Australian bank's foreign-currency account solves it the same way it does elsewhere: hold USD, convert on your terms. Verification checklist for Australian buyers

Confirm there is no minimum-trading-days requirement you cannot physically meet, and confirm whether the days must be profitable or merely active.

Confirm the daily loss limit reset time in your timezone. A daily limit that resets at 17:00 New York resets at 08:00 AEST, which means an overnight hold spans two separate daily windows — a nuance that has ended more evaluations than any exotic rule.

Confirm weekend holding and swap treatment, and check the payout schedule against your session. Weekly payouts are worth less if the cut-off falls in the middle of your trading window.

How the ATO treats prop firm payouts

Payouts from a prop firm are ordinary income in the standard case: you are providing a service under a profit-share arrangement, not disposing of a CGT asset, so the CGT discount is not in play. The income goes into your individual return as business or other income, taxed at your marginal rate, with the Medicare levy on top.

Because the payer is offshore, no PAYG is withheld. Once your income is consistent, the ATO will typically move you into the PAYG instalments system, and until it does you should be setting aside your marginal rate on every payout yourself. An ABN is usually appropriate if you are operating as a sole trader; GST registration generally is not, since the service is supplied to a non-resident.

Deductions follow the ordinary business test: evaluation fees including the failures, platform and data subscriptions, VPS, a proportion of home internet and home office, and professional fees. Traders working the US session from home in the early hours often have a stronger home-office claim than they realise, but it must be substantiated.

USD payouts are translated at the ATO rate on the date of receipt. Stablecoin payouts create a separate crypto CGT event on conversion, tracked from the value at receipt.

Are prop firms legal in Australia?
Yes. An evaluation is not a financial product issued to you and the firm is not acting as an Australian financial services licensee, so it falls outside ASIC's CFD intervention order. That also means no AFCA route and no compensation scheme if a firm refuses to pay.
